The Constitution creates a system that was designed to fail AND the Essay

The Constitution creates a system that was designed to fail AND the institution of a set of fundamental American values - Essay ExampleIt also guaranteed a stronger horizontal separation of power amongst the executive, the legislature and the judiciary, thus improves institutional checks and balances while at the same time granting some autonomy to various government organs (Ellis 49). This is a weakness, since it is the states that are closer to the people and therefore stand a better chance to respond faster to the need of the people, in comparison to the federal government (Ellis 49). The coition has on some occasions exercised its legislative power to pass laws that interfere with the processes already running in the states. For instance, in United States v. Morrison, pursuant to its powers under the mercantilism Clause and the Fourth Amendment (Section 5), the Congress had enacted a statute, Violence against Women Act (VAWA) which provided civil remedies to gender based violence victims against their assailants. This was based on argument that such injustices against women hindered their let go participation in interstate commerce and thus a remedy was essential. The court struck down a part of this law since the law was not dealing with cases that were economic in nature. T he congress had over stretched its powers under the constitution to interfere with state court, by offering a federal filing for such cases. VAWA dealt with a social issue (gender violence) and its economic impact on interstate Commerce was indirect and marginal. Similar scenario arose in United States v. Lopez, where the court pointed out that moneymaking(prenominal) Clause could only be applied in cases that are directly economic in nature. United States v. Morrison defines the sensitive question of the relationship between the congressional powers and the State powers, and in particular, the extent to which the congress may limit areas that are traditionally defined as being within the scope of the state. These decisions reveal juridic activisms in favor of state sovereignty at the expense of federalism and to strengthen the state power. This responsibility of loyalty to clients is referred to as a fiduciary obligation, and it places a high reliance standard of care and expectations upon the trustee (bank) (Matthews, 2006).The copies of the bank statements indicate that there have been massive withdrawals for the trust by Mr. Raymond although the trust investment has been positive. This can be attributed to the manner in which Mr. Raymond has been spending on the many trips he takes to visit his children and also for leisure ove rseas. When the trust funds are

Innovation. Innovative techniques of a manufacturing company Assignment

Innovation. Innovative techniques of a manufacturing company - Assignment ExampleIt is not possible to apply the innovative techniques of a manufacturing company, in a help empyrean. This is because the two business models operate in different spheres, and the main different is depicted in the nature of the products they produce. The profit sector deals with intangible goods, while the manufacturing sector deals with tangible goods. An compositors case of a service is the delivery of mails, by Fed Ex Company (Chang, 2011). It is important for the service industry to create a finish of innovation while conducting their activities. This is because the service sector is a major employer, and greatly contributes to the exposement of an economy. However there are scraps that can prevent entrepreneurs in a service sector from innovating. This is because there arent any clear guidelines on how to innovate for a service sector (Chang, 2011). However, an entrepreneur can overcome this challenge by appreciating the service in which an entrepreneur provides to the community. This will create a proper wit that will advocate for the improvement of the service to carter for the various call for of its customers. It is essential to separate the physiology, structure and the context within which the business operation focuses on. By doing this, the organization will broaden its scope of innovating, and therefore overcome the challenges that the service sector faces in developing an innovation (Omachonu et al, 2010). An example depicting an organization that appreciates its scope of operation and created ideas for its relevance in the market is easy jet. The main fair game of the company is to make it easier for customers to access go. As a result of this objective, the company developed various products such as, Easy Cruise, Easy Pizza, and EasyCinema. This was possible because of the right mindset emanating from the management because of appreciating the context of their business operations. Anformer(a) method of overcoming the challenges is to create a research and development subdivision within the organization. The department should be responsible for carrying let on a market research on the requirements of a customer, and on how to satisfy their needs (Dodgson et al, 2010) . The department should be responsible for analyzing the feedbacks of the sales representatives of the company, and the various customers that the organization serves. The department should also look at the strategies of the organizations competitors, and analyze their innovative tendencies. Basing on the results of their analysis, the department should advice the management of an organization on whether to copy the style of their competitors mode of operation, or to develop their own strategies. On this note, the R and D department is an important element of overcoming challenges that emanate from innovating in a service industry. Another method of overcoming the cha llenges that emanate for innovating in a service sector is to focus on the core elements of the company (Chang, 2011), this is as opposed on innovating in the supplemental elements of the company, such as warm customer care services, effective problem solving mechanisms, after sales services, such as an extra service to the customer without any charge. These supplementary services can be copied by their rival companies. On this note, to maintain an edge over their rivals, the organization should focus on improving its core business objective. An example is the innovative ideas of CNN in making its services accessible on a 24hr basis. Google initiated measures of improving the speed of its search engine network, and Fed Ex initiated measures of speedily delivering packages to their clients by working for 24hrs a day. However, it is not only important to focus on the core element or objective of the business, it is important to focus on other supplemental elements of the business or ganization while creating a product that will be attractive in the market. In as much as supplementary ser

Proofs for the Existence of God Essay Example | Topics and Well Written Essays - 1000 words

Proofs for the Existence of idol - Essay ExampleThere are unanswered questions even today about the importance and creation of theology as creator of this universe or the galaxies that astronomers see through their ever more powerful telescope. If it is conceivable that this universe had a beginning and impart have an end, then it is logical to assume that it must have had a creator, since cipher can be created out of nothing. While John Leslie in his treatise on the subject of ethically required existences argues that there must be proof of God somewhere in the system of things, St Anslem of old puts the cart before the sawhorse and argues that the importance that religion and mankind gives to God proves his existence (Anslem, 4)1. Explication To my mind, both philosophers are arguing for the existence of God, but each from a different standpoint. John Leslie, in his argument for what he calls ethically required existences, relies on the tenets of naturalism and prescriptivism to explain his viewpoint (Leslie, 1972222)2. St. Anslem however takes a more unconventional approach and states that to think of God is to think of the Greatest Power that the Universe has ever known, and undoubtedly since some Power created this Universe and every living and inanimate thing out of nothing at all, that Power can completely be God and belong to God. No one can create something out of nothing except God. hence it is imperative that we believe in the existence of God, the Creator and Master of All the known universe and its galaxies etc. It is far better to accept the existence of God because each creature in the universe is the product of intelligent design and that presupposes a creator. Main Argument John Leslie starts with the notion that we cannot label anything as intrinsically life-threatening or bad unless we know what good and bad is, therefore we are making a judgment that can only depend on prior knowledge or something that is inherent in mans nature or existence. If morality or ethical behavior is what separates us from the animals or at any rate, the creatures that lie below us on the totem pole of existence, then there is someone or something that put it in our hearts, or minds and our souls, and that could only be God. No wonder it is often said that Conscience is the voice of God in man. The very fact that we all come into this earthbound existence with an inbuilt sense of morality is proof enough of the existence of God, a creator that prefers us to be good and do good, but has precondition us free will all the same, in order to test our level of obedience to him in this earthly life. To support St. Anslems argument, since it is so confusing, I prefer to put forward what has been called Pascals Wager to prove the existence of God. Pascals Wager induces us to wager that there is a God, rather than there is not. He has very interestingly drawn out parallels whether we believe in God or do not believe in God because we cannot do both. Either we believe in the existence of a Supreme Being or we do not. But suppose if we did and there is thusly a God that meets us at the Pearly Gates or whatever as we pass into the afterlife. In that case we would indeed be blithe that we assumed correctly that God did exist. Indeed this assumption also makes our moral life on Earth easier as well. We take pains to do good and be good because

However, the article challenges this sateion as it does not seem tenable, though it concedes to the notion that to a certain extent, video games whitethorn impact childrens behavior. The article focuses on the premise that video games contain a lot of violence, bloodshed, objectification of females and sexual content. However, it emphasizes a more significant concern that conceive experience in the media, in terms of audio visual components, are extraordinarily life like, and these effects can be particularly striking in violent games (1). It also concedes to the fact that despite the existence of rating systems by the ESRB, children disregard the classification and even those below 13 years watch the content that is permissible to those in the age group of 17. The article also refers to research studies that lend credence to concerns about the impact of violent video games (3). However, this does not kick upstairs that games such(prenominal) as GTA cause violent behavior in children. The article, further, challenges this concept by arguing that there is little or no evidence to domiciliate all of these theories which purport that violence in the video games such as GTA can provoke violent behavior in children (2).I believe that flick to violent media or video games alone cannot make children to indulge in violent behavior. My research premise is based on the concept that many factors such as genetic framework, social circumstances, psychological reasons etc cause violent behaviors in humans. Therefore, children who possess any such specific traits or who remain exposed to any of the causative elements, stand the chance of displaying violent behavior. I do not agree with the evidence based on a study among 1254 students, which indicates that violent games cause aggression in children. It claims that those who play games are more likely than their

Reflective Paper on Gay Marriage Essay Example for Free

Reflective Paper on Gay Marriage EssayToday many volume puzzle their own opinions and beliefs when it comes down to the topic of gay mating. I personally smelling that gay brotherhood should be legalized. Yes God said, That marriage is to be between a man and a woman. My question is, What gives spate the right to judge or tell an new(prenominal) human-being who to love or how to love? I personally obtain its insulting to ones integrity and people should be open to express their love how they see fit. For centuries the United States has been known for its obliging rights and freedoms. many a(prenominal) Ameri poops argon angered by the idea of same-sex kindreds and marriages. The biggest reason to why heterosexuals are against gay marriage is based primarily on their spiritual beliefs. So Im wondering, Whats wrong with the idea of both people being together who love and care for each other urgencying to spend their lives together? Of course the gay society is g reatly misunderstood because many people who arent living a homosexual lifestyle in effect(p) refuse to listen. close of these individuals would rather be close-minded to the topic, rather than trying to understand the daily struggles and what it means to be gay in America or any other domain for that matter.Same-sex couples arent asking for special treatment, but just to be treated the same as a straight couple. The ethical theory that provides the near stay for same-sex marriage is utilitarianism. Utilitarianism is a natural way to see if an conduct is the right thing to do (or wrong thing to do) is to look at its results or consequences. Theories intromit us the opportunity to identify the problem and then find ways on how to resolve them. One example would happen to be the ordinal commandment, Thou shall not lie. Given this statement we a human-beings, tend to lead busy lives and in order to not go against what we may confine said, well lie. We do this to keep from hurt ing ones feelings. In doing this we as people look at the consequences of our actions to determine how we can make the situation better. It also states that at that place is an obvious solution that is fair and that may be one that appeals to common sense also. If we can mix races and people are allowed to get unite just because. Then why arent same-sex couples allowed the exact same opportunity? What makes people so against and afraid of allowing others to love and be with the person they choose? In a utilitarianism mind-set, society cant say who should have a relationship. Much of the controversy rises from the decision on how one chooses to define or view marriage. eve though, it was between a man and a woman, man and a man, woman and a woman. Relativism is a concept that points of view have no absolute rightfulness or validity. In contrast, people who are supporters of gay marriage tend to look at the glass half-full instead of just basing their decisions primarily on religio us beliefs. Both sides have a very valid argument when it comes down to discussing this topic. From past occasions of inequality, gay rights are the next big step to creating careen and an equal society. Many people of the Republican Party feel that allowing same-sex marriages will change how people view religion and family values. A large majority of people and faces that are for gay marriage feel that not allowing same-sex marriage to be legal feel that its a violation against the law of the Equal security system Clause. Its the clause of the 14th Amendment that prohibits states from denying any person within the jurisdiction of equal protection. So for the laws to not allow same-sex couples unite is going to create a lot of controversy and scrutiny. Homosexuality is defined as the quality of being homosexual or as the erotic activity with another of the same sex. Up until the year of 1973, being homosexual was known to be a mental disorder, which was stated as such in psycholog y journals. Many often feel that legalizing gay marriage will lead to the legalizing of other things.Such as pedophilia and polygamy which are controversial subjects but not as much as gay marriage. Even though comparing pedophilia and polygamy to gay marriage is a little much, people feel that allowing gay marriage goes against their morals, their views on society, lives they want for their children, and the future. For some violating same-sex couples civil right is worth it in the end only because they want to protect the value of a man-woman type marriage. To deny gays and lesbians the right to marry is in violation of their civil rights as a citizen of the United States of America.Legalizing gay marriage is not to attack how one feels and how they view things, but so that those can have a chance at equality also. Gay marriage is a very emotional topic and is going to be for years to come. So many people feel that homosexuality is wrong and not normal and in that locationfore be lieve that homosexuals dont deserve the right to be married. multitude are going to debate on whether gay marriage is right or wrong, thats just the way it is. For just about of it Christian groups have been the chief of state when it boils down to same-sex marriage.Growing up in a Christian faith home we were taught that God loves everyone. So answer this question, Does that circle of people not include gays or lesbians? The Constitution gives our rights thanks to the founding fathers of our country. As Americans is this country we have many rights such as freedom of speech, freedom of worship, and so many more. Even though there are many rights, some are limited to an extent. In todays society are political sympathies is controlled by politicians who make a majority of the decisions. Even though we are given freedoms for some reason we are scared of using them. The U. S. seems to be huge playing field, but then we have individuals who decide to take away balls, swings, slides , etc. Why do they get to take these things away? Gay marriage will continue to be a critical topic in todays society, thats just fact. A recent study shows that there are approximately 2, 900,000 homosexuals living in the U. S. Some chose not to give come out there sexual orientation. The only states where gay marriage is legal are Massachusetts, Connecticut, Iowa, Vermont, New Hampshire, New York, Maryland, Maine, and Washington. The following countries allow gay participatorships which are Norway, Sweden, Greenland, Hungary, Iceland, The Netherlands, France, Belgium, Portugal, Germany, and Finland. A same-sex couple is not allowed to file a joint tax return in order to lower their taxes or allowed to visit a infirmary if an illness was to occur. In this national only next of kin are allowed to make hospital visits. I feel that by allowing gay marriage across the country will then give equal rights for an individual. It will decrease the amount on violence among people and will bring the country together.People often ask, Why cant same-sex couples be fine with just the choice of civil union? They say this because they couldnt possibly understand the difference between marriage and civil union. advantageously-bred union is the legal status that ensures to same-sex couples specified rights and responsibilities of married couples. Marriage is the state of being united to a person of the same sex in a relationship like that of a traditional marriage. Civil unions dont allow the same assurance that marriage does. In our case marriages are known worldwide, as for civil unions they only exist in the state in which the couple live in.Marriage for same-sex couples happen to be way more beneficial in this case. Say for instance in a civil union, if one of the partners passes away, the living spouse cannot receive Social Security or any benefits from the government. This leaves that person in a financial crisis even though they had been with them for years. In a m arriage, couples are entitled to receive their spouses Social Security or for that case any other benefits in case of death. This guarantees them definite financial security and rights that will protect them.In a marriage, as a couple you can move from state to state, or country to country and still be granted the same rights and protection. Where as in a civil union if you move to another state theyre rights are long being protected, that in which they were when they were living in the state they happened to be married in. One of the biggest benefits of marriage is the right to adoption. Several states dont allow gay adoption or allow second parent adoption if an event such as loss or separation happened. Adoption is the act or process of adoption a child. Second parent adoption is when one person adopts the child of his or her partner. There are 16 states that definitely allow joint gay adoption which are Arkansas, California, Colorado, Connecticut, Washington D. C. , Illinois, In diana, Maine, Massachusetts, Nevada, New Hampshire, New Jersey, New York, Oregon, Vermont, and Washington. One of the most widely cited arguments that happen to be against same-sex marriage rights is that it will harm children that happen to be raised in the silver lining of these relationships. Studies from social science research show that the evidence from this statement is not a supported argument. Scientific literature shows that children who happen to grow up with one or two gay/or esbian parents cope as well in emotional, cognitive, social, and sexual functioning as children raised in a heterosexual household. The optimal development seems to be influenced more by the nature of the relationship and interactions within the family, rather than by the structural form it takes. Since the year of 2002, studies have shown that children with same-sex parents do as well as children of parents of the opposite sex. This has allowed major psychological and health organizations such as ( The American Psychological Association) and many more to support same-sex marriage and parenting. The word GLAAD stands for (Gay and Lesbian Alliance Against Defamation). This organization creates change. GLAAD amplifies the voice of the gay community in order to keep equality at the forefront of Americas cultural conversation. Their impact on newspapers, magazines, blogs, radio, television, movies, and so much more, which transforms attitudes to bring roughly real change. They hold the media accountable for the words and images they produce. When the media is allowed to be a platform to defame and stereotype the LGBT people, thats when GLAAD steps in to take action. They leverage 25 years in media relationships and countless hours of media advocacy in order to send important messages against homophobia and discrimination. They strengthen other organizations so that they can leverage media, engage in local communities, and advance social change. Right at this present time GLAAD happe ns to be working with local organizations in more than 30 states to build support for equality. By collaborating with LGBT leaders and advocacy groups, happens to be the key to increasing the visibility of the gay community, changing hearts and minds, and securing full and lasting equality.Suicide is the third most leading cause of death among adolescents and non-suicidal self-harm occurs in 13-45% of individuals within this age group. This make this particular incident a major public health concern in todays society. Lesbian, gay, bisexual, and transgender youth are particularly at risk for engaging in these behaviors. Even though, not much is known to what are the unique(predicate) risk factors associated with suicidal ideas and self-harm behaviors within the population. A history of tone-beginninged uicide, impulsivity, and prospected LGBT victimization, and low social support were the reasons behind an increased risk of suicidal ideas. Lesbians are two times more likely to att empt self-destruction than straight woman, and gay men are six times more likely to attempt suicide than their heterosexual peers. Attempts by gay and lesbian youth account up to 30% of all completed suicides. Gay teens are three times more likely to attempt suicide than their heterosexual peers and gay youth are four times more likely to make a suicide attempt requiring medical attention. The Trevor Project is the leading national organization providing crisis intervention and suicide prevention services for lesbian, gay, bisexual, transgender, and questioning youth. This organization was founded in 1998 by James Lecesne, Peggy Rajski, and steamy Stone, who are the creators behind the Academy Award winning short film called, Trevor. That is a timeless coming of age story about love, loss, and to learn how to be yourself. The Trevor Project is determined to end suicide among LGBTQ youth by providing life-saving and life-affirming resources.Which include 24/7 crisis intervention life line, digital community, and advocacy/ educational programs that create safe, supportive, and plus environment for everyone. The vision is to provide a future where the possibilities, opportunities, and dreams are the same for all youth, regardless of sexual orientation or gender identity. Inclusiveness is one of their mantras. This organization believe that everyone should be treated like a human-being, regardless of sexual orientation, gender identity or expression, race, ethnicity, religious practice, ability, or size. The Trevor Project is also a Champion of Change, an honor that was presented by the White House for their innovative work to save the lives of LGBTQ young people. In conclusion, I dont think Ill ever quite understand the argument on whether homosexuals should have the right to marry and live their lives the way they choose. As citizens of this country, we all deserve the right to aim and have happiness. Isnt that normally part of forming relationships? It transpir es when we fall in love and are able to love the one we have chosen to be with. Even, if our partner happens to be of the same or opposite sex. That shouldnt matter because love is love, no matter how you see it. For me I feel that same-sex marriage shouldnt have to resort in ethical controversy, it should be left alone. I feel this way because since the age of fourteen I knew that I was gay. Throughout centerfield school and high school I kept it a secret and didnt tell anyone. It was very hard because I was scared that if I came out my family, friends, and my peers wouldnt accept me. I went through phases of anxiety, anger, lonliness, depression, and an attempt of suicide. All because I kept who I truly was locked away all because the fear of rejection.Thats a very big pill to have to swallow. By deciding to keep this a secret I wasnt able to live out my uprightness and be who I truly am. Recently at the beginning of this past year I decided that it was time to come out to my fam ily and friends. It was one of the most hardest and scariest things that Ive ever had to do but I know it had to be done. Now that I have the acceptance of my family and friends Im now able to live my life and be truly happy. Its as if I had been suffocating for so long and now I can breathe again. I cant explain it but its the greatest feeling in the world.I want every teen or young openhanded struggling with who they are to be able to be hunky-dory and love themselves on the inside as well as the outside. Theres a saying, God doesnt make mistakes. So for every person thats ever been told that theyre a mistake just know that mistakes are okay because no ones perfect, but never ever lose your passion to express and be who your are. I just feel like Im finally able to live out my goals, dreams, and ambitions I have for my life. Its as if I have been given this new lease on life called joy. I refuse to let anyone or anything take it away.
